Member Submissions

Network Cornwall may provide members with the capability of posting to the web site or otherwise transmitting data, text, music, sound, photographs, graphics, video, messages and other materials to or from this web site ("Members Information").

Any Information you post to this web site or transmit to and from this web site will be considered non-confidential with respect to other members. Network Cornwall will have no obligations with respect to such Information. By posting and transmitting Members Information you are solely responsible for the organisation, completeness, accuracy, ownership, publication and dissemination of such Members Information, and you hereby agree that you and not Network Cornwall are entirely responsible for the contents of such Members Information.

Network Cornwall assumes no obligation to monitor or filter any Member's Information. For this reason Network Cornwall does not accept responsibility or liability for Members' Information. However, Network Cornwall does reserve the right, at its sole discretion to refuse, remove, or edit any Member's Information posted or transmitted on or through the Network Cornwall web site.

Network Cornwall will be free to use Members Information for any commercial purpose.

Grievance Procedure and member to member complaints

Where any grievance is raised by members regarding the behaviour of another member of Network Cornwall, the matter will be dealt with by Digital Peninsula Network Limited head office staff whose decision will be final and absolute. Digital Peninsula Network Limited reserves the right to terminate a membership where complaints have been raised by other members, and in this instance no membership fees are refundable.

The final decision in any matters relating to Network Cornwall membership rests entirely with Digital Peninsula Network Limited.

Indemnity

You agree to fully indemnify Network Cornwall against all claims, losses, damages, demands, costs (including reasonable legal fees) and expenses arising in any way from or in connection with your use of this web site, any violation of these terms, or any information posted on or transmitted through this web site by you.

Unless otherwise noted in this web site, all content of this web site is the property of Network Cornwall, © 2011, Network Cornwall.

Nothing in this agreement shall exclude or restrict the liability of Network Cornwall for fraudulent misrepresentation and/or for death or personal injury arising as a result of the negligence of Network Cornwall, its officers, employees, agents and/or sub-contractors.

Governing Law

These terms and conditions are exclusively governed by English law and the parties hereby submit to the exclusive jurisdiction of the English courts.

MEMBERSHIP TERMS & CONDITIONS

These terms will govern the relationship between Network Cornwall and its members.

REGISTRATION

a) On registration, you must provide us with accurate, complete registration information and it is your responsibility to update The Network web site if that information changes.

b) You are responsible for all use of the Site made by you or anyone else using your user name and password, (collectively "ID") and for preventing unauthorised use of your ID. If you believe there has been any breach of security such as the disclosure, theft or unauthorised use of your ID or any payment information, please notify us immediately by emailing the Chairman at the address published in the Membership Directory.

c) Membership is non-transferable.

DUTIES OF MEMBERS

a) Members shall ensure that all membership information and forms are maintained and submitted as required.

b) Members shall promptly pay all dues and fees owed to The Network.

RESIGNATION

a) Any member may withdraw from membership of The Network at any time for any reason by giving written notice to The Network.

Digital Peninsula Network Limited reserves the right, in its sole discretion, to suspend and/or terminate membership of Network Cornwall at any time, with or without notice, for any breach of our Terms and Conditions to the subscribed services, or for any other reason. Should Digital Peninsula Network Limited decide to terminate a member’s membership, no fees are refundable. Upon termination of membership the right to use all member services immediately ceases.

The final decision in any matters relating to Network Cornwall membership rests entirely with Digital Peninsula Network Limited.
